REGULATION

On the Training Center of the State Personal Data Protection Agency under the Cabinet of Ministers of the Kyrgyz Republic

General provisions

1. This Regulation defines the legal and organizational basis for the activities of the Training Center of the State Personal Data Protection Agency under the Cabinet of Ministers of the Kyrgyz Republic (hereinafter referred to as the Training Center).

2. The Training Center is an independent legal entity, has an independent balance sheet, accounts in financial and credit institutions in national and foreign currency, stamp, stamp and official letterheads with its full name in the state and official languages.

3. Property (movable and immovable) The training center is state property transferred to it on the right of operational management.

4. The Training Center is a subordinate subdivision of the State Personal Data Protection Agency under the Cabinet of Ministers of the Kyrgyz Republic (hereinafter referred to as the Agency).

5. The Training Center carries out its activities on self-financing terms and on the basis of an appropriate license issued in accordance with the established procedure by the Ministry of Education and Science of the Kyrgyz Republic.

6. The Training Center in its activities is guided by the Constitution and laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic, generally recognized principles and norms of international law, international treaties that have entered into force in accordance with the legislation of the Kyrgyz Republic, as well as this Regulation.

7. The Training Center interacts with the state bodies of the Kyrgyz Republic, local self-government bodies, public associations, citizens and legal entities.

8. The organizational and legal form of the Training Center is a state institution established on the right of operational management. The Training Center, with respect to the property assigned to it, exercises the right of ownership, use and disposal in accordance with the procedure established by the legislation of the Kyrgyz Republic.

- in the official language: "Training Center of the State Personal Data Protection Agency under the Cabinet of Ministers of the Kyrgyz Republic".

- in the official language: "Okuu borboru";

- in the official language: "Training Center".

The legal address of the Training Center is: 265-a Chui Avenue, Bishkek, 720071, Kyrgyz Republic.

Goals and objectives of the Training Center

9. The main purpose of the Training Center is the implementation of additional education programs for personal data subjects, as well as scientific activities.

10. The main objectives of the Training Center are training and advanced training of citizens, employees of the public administration sector, local self-government bodies and employees of holders (holders) of personal data on personal data protection, work with personal data, information security, digital hygiene, digital skills, as well as the development of scientific approaches to the formation of digital legislation and legislation in the field of personal information.

The Training Center also develops recommendations for the implementation of the most successful international practices on personal data protection and privacy.

Main functions of the Training Center

11. In order to implement these tasks, the Training Center performs the following functions:

1) training and advanced training of citizens, employees of the public administration sector, local self-government bodies and employees of holders (holders) of personal data;

2) development of textbooks, reference literature, brochures on personal data protection, work with personal data, cybersecurity, digital hygiene, digital skills;

3) creation of an effective training system;

4) introduction of innovative technologies into the educational process;

5) conducting seminars, meetings, trainings, conferences;

6) conducting explanatory and advisory work in the field of personal data protection;

7) implementation of direct relations with foreign and international institutions, legal entities and individuals on educational, scientific activities, professional development of teaching staff on a contractual basis;

8) performing other functions necessary for the implementation of the tasks assigned to the Training Center.

4. The procedure for conducting training

12. The training is conducted according to the curricula and programs drawn up jointly with the structural divisions of the Agency.

Languages of instruction: Kyrgyz, Russian and any foreign language, depending on the requests of listeners and the capabilities of the Training Center.

The duration of training is determined by the curricula.

The Training center has the right to involve specialists of the Agency, as well as other ministries and departments for the implementation of the educational process.

13. Students who have been trained and retrained at the Training Center receive a document of the sample established by the Agency.

5. Organization of the activities of the Training Center

14. The management of the Training Center is carried out by the Director appointed and dismissed by the Chairman of the Cabinet of Ministers of the Kyrgyz Republic on the recommendation of the Director of the Agency.

15. Director:

1) submits for approval to the Director of the Agency drafts of the structure and staffing of the Training Center within the limits established by the payroll fund and the maximum staffing;

2) in accordance with the established procedure, appoints and dismisses employees of the Training Center;

3) organizes the educational, methodical, production work of the Training Center;

4) is personally responsible for the fulfillment of the tasks assigned to the Training Center;

5) performs other functions and powers to manage the activities of the Training Center in accordance with the legislation of the Kyrgyz Republic and this Regulation.

16. The Director of the Training Center has the right to:

1) make proposals to the Director of the Agency on improving the educational process, educational and methodological work and material and technical base;

2) act on behalf of the Training Center without a power of attorney, represent its interests;

3) conclude contracts on behalf of the Training Center with legal entities and individuals, issue power of attorney to employees of the Training Center;

4) to issue orders, orders, give instructions and instructions within their competence, which are mandatory for all employees of the Training Center;

5) to correspond with organizations and institutions on issues related to the work of the Training Center;

6) to establish the conditions of remuneration of educational and auxiliary and administrative personnel in compliance with the legislation of the Kyrgyz Republic and within the established salary fund;

7) send their employees on official business trips in accordance with the established procedure;

8) carry out, in accordance with the procedure established by the legislation of the Kyrgyz Republic, the relocation of full-time employees of the Training Center, take measures of encouragement and disciplinary punishment, as well as provide financial assistance to employees at the expense of a special account.

17. The structure and staffing of the Training Center are approved by the Director within the approved staffing and payroll.

The employees of the center are not state civil and municipal employees, as well as junior and technical service personnel.

18. Financing of the activities of the Training Center is carried out in accordance with the established procedure at the expense of:

1) funds received in the form of tuition fees;

2) allocations from the state budget in the presence of a state order for the training of state civil servants and municipal employees;

3) funds received for the execution of contracts for the training and retraining of specialists of legal entities and individuals;

4) funds transferred free of charge by legal entities and individuals, including foreign states;

5) own funds from research, publishing, production and commercial activities;

6) other sources provided for by the legislation of the Kyrgyz Republic.

19. The remuneration of teachers is determined in accordance with the established procedure in accordance with the volume of the completed academic load.

20. Income from the activities of the Training Center is credited to a special account of the Agency in the system of the Central Treasury under the Ministry of Finance of the Kyrgyz Republic.

6. Final provisions

21. The reorganization and termination of the activities of the Training Center are carried out in accordance with the civil legislation of the Kyrgyz Republic.

22. In case of termination of the activity of the Training Center, the documents of the Training Center are stored and used in accordance with the Law of the Kyrgyz Republic "On the National Archival Fund of the Kyrgyz Republic".
